In October of 2008, Florida moved away from the custody and visitation method of post-divorce child care and replaced it with a more comprehensive parenting plan that clearly defines each parent's rights and responsibilities with regard to their children. In most cases, parents agree to the terms of a parenting plan. If they can't, the court will decide on the terms for them.

In general terms, the parenting plan covers time-sharing schedules, holiday schedules and decision-making authority. The primary focus of any custody agreement or parenting plan is the best interests of the children. In most cases, if the parents agree to a parenting plan, the court will approve it unless there is a concern for the welfare of the children.

Decision-making authority on behalf of the child is a significant part of the parenting plan. Some decisions can be made by either parent and some are required to be made jointly between the parents. Some of the decision-making authority defined by the parenting plan includes:

  • Where to attend school, church or day care
  • Doctors, hospitals and medical care
  • Sports and other extra-curricular activities
